1. Information about the website

1.1. The Romania-Insider.com website is owned by Business Insider SRL, based in Bucharest, District 1, 8 Puskin Alexandru Sergheevici St., registered at the Trade Register under number J40/6901/2011, C.I.F. 28588173, email: office@romania-insider.com, phone number +40 (0)722 206 413, further referred to as “Us”, “We”, “Romania-Insider.com”, “Business Insider SRL”.

1.2. Romania-Insider.com is an online news portal with information, reviews and analysis of various social, economic and cultural, daily news, advertising to third parties (on the website or in the newsletter, as banners or text advertising marked as such - advertorials, native content, press releases), opinion and editorials, all addressed mainly to English speakers and published exclusively in English.

1.3. Articles published on the Romania-Insider.com website are written in English both by editors and journalists that are part of the editorial team of Romania-Insider.ro and by third parties called Guest Writers.

1.4. When purchasing a membership on our website, additional terms of service apply - you can check section 7 below for our terms of service for providing our membership services.

2. Intellectual Property

2.1. Romania-Insider.com is owned by Business Insider SRL, and is subject to the copyright law. The use, reproduction and transmission, even partial, of the information appeared on the website to a third party, can only be done with the written permission of Business Insider SRL. Indication of the source of information collected from the Romania-Insider.com website does not remove the obligation to obtain consent from Business Insider S.R.L, for the use, reproduction and transmission of information.

2.2. Given that you believe that certain content found on the Romania-Insider.com website violates your intellectual property rights, privacy rights, publicity or other statement rights, please send an email to office@romania-insider.com with violated rights to allow Romania-Insider.com administrators to act in accordance with the legal provisions according to Law 365/2002 on electronic commerce.

2.3. Romania-Insider.com is a trademark of Business Insider S.R.L., registered at the Office for Inventions and Trademarks under no. 121 916. It is forbidden to use it in any way, without written permission from Business Insider SRL.

3. Guest writers

3.1. Guest Writer is the person who wants to write and publish regular articles of interest to Romania-Insider.com with his own initiative and free title.

3.2. Permission granted by Business Insider SRL and by the Guest Writers in order to publish articles written in English on the website of Romania-Insider.com is done by signing a Partnership Agreement between the two parties.

3.3. By signing the Partnership Agreement, Business Insider SRL undertakes to give its consent to the Guest Writers to send with free title anything they believe to be of interest to Romania-Insider.com readers, in order to promote and popularize the author of the article and the Romania-Insider.com website. Romania-Insider.com will give its editorial feedback on the stories submitted by Guest Writers for them to make the needed changes, and in some cases, if this article is not in line with Romania-Insider.com’s ethical policies, it may not be published.

3.4. Guest Writers agree not to post on or deliver to romania-insider.com materials which would be based on content illegal, obscene, defamatory, threatening, pornographic, harassing, or other materials that would violate any law and element that could damage the website, as well as to respect the legal provisions in force concerning copyrighting or industrial property. They also agree to respect editorial ethics and not advertise for their projects, or advertise for projects of third parties they are in relation with.

3.5. Guest Writers undertake to guarantee the materials sent to Romania-Insider.com and that they are in at least one of the following ways: A. the author of such material, B. the holder of the copyright on such materials; C. have the consent of the copyright owner to post such materials on the website.

3.6. Guest Writers understand that they are responsible for any content posted by them on the Romania-Insider.ro website, and they are the only ones who can be held accountable by the competent authorities for breaching any legislation.

3.7 Guest Writers give consent to Romania-Insider.com to edit and improve the original article sent by the Guest Writer, collaborating with the Guest Writer in reaching the best form for their piece, after which Romania-Insider.com has the means of utilizing these materials, and, once published, the Guest Writers will not be able to request disposal.

3.8 Eventual litigation that might occur regarding the present contract will be solved amicably. If this is not possible, the litigation will be solved through addressing the legal system.

Access to our free content. Use of ad blockers and similar technologies

Our core content of daily news and updates on Romania remains free and accessible to any visitor of our website. You will also have the possibility to subscribe to or continue to receive 5 of our free newsletters, supported by advertising: RI Daily News, Positive Romania News - Weekly, Real Estate - Weekly, HR and Careers - Weekly, Life and Travel - Monthly. We are able to provide this content freely to our readers only with the financial support from our advertising partners.

By continuing to access our free content you agree that you will not use any means to remove or disable the display of advertising on our website, including any third party software or browser add-ons.

4.1. We commit to maintaining the security of your data and to ensure that appropriate measures are taken against unlawful or unauthorized processing of personal data, against the accidental loss of, or damage to, personal data, by putting in place the appropriate hardware and software security measures and enforcing the appropriate procedures to maintain the security of all personal data from the point of collection to the point of deletion, including keeping your information confidential by allowing only the authorized people to access the personal data provided.

4.2. We process the personal data provided by you in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation)..

4.3. Our general purposes for collecting your personal data, as set forth in our Privacy Policy, here, are: to deliver services to you or answering the requests received via the forms on our website, respectively sending the newsletters you subscribed to, or the advertising/ services offer required, for marketing purposes, for sending you direct advertising via email, about our own products and services or on behalf of our selected partners with your consent; in order to fulfill legal obligations imposed by authorities or for the purpose of legitimate interest of Business Insider SRL and third parties, provided that such legitimated interest does not override interests or fundamental rights and freedoms of you.

4.4 Also your express refusal for processing your personal data, will result in termination of any processing of personal data as far as you are concerned. If some of your data is incorrect, please let us know as soon as possible.

4.5 BUSINESS INSIDER SRL is a carrier of data with personal character, registered in the “Registrul de Evidenta a Prelucrarilor de Date cu Caracter Personal” under no. 28263.

5. Unsolicited commercial messages

5.1. Romania-Insider.com is against sending of unsolicited commercial messages (spam) or any other messages without a legal basis consisting of: the explicit consent of the user, legitimate interest to fullfil a contractual obligation or operational obligation in relation to the services provided to you. Romania-Insider.com will enable subscribing to our free themed newsletters with news about events and advertising, simply by entering your name and e-mail.

5.2. You will be able to unsubscribe at any time from these newsletters. For any technical problems with commercial messages sent by Romania-Insider.com please send an email to office@romania-insider.com and we will solve the problem as soon as possible.

6. Governing Law

The rights and obligations of the parties imposed by these Terms and Conditions as well as all legal effects which produce this Agreement shall be construed and governed by Romanian law in force.

7. Memberships and subscriptions

7.1. Free account. Creating an account on Romania-Insider.com is free. A free account gives you access to up to three (3) premium articles per calendar month, in addition to all freely available content. The counter resets at the start of each calendar month.

7.2. Insider+.The Insider+ membership gives you unlimited access to premium content and an ad-light reading experience. It is offered as a monthly subscription (€5 per month) or an annual subscription (€48 per year), prices including VAT. New Insider+ subscriptions start with a 7-day free trial: a valid payment card is required at sign-up, and the first charge occurs at the end of the trial unless you cancel before it ends.

7.3. Insider+ & Press Review.This membership includes everything in Insider+ plus our daily press review, delivered by email every weekday morning. It is offered at €17 per month or €168 per year, prices including VAT, with the same 7-day free trial. Existing Insider+ members can upgrade from their account page; the price difference is prorated by our payment provider.

7.4. Business memberships. Organisations can purchase an annual Business membership with a number of seats (minimum 2), at a price per seat per year that decreases with volume, as displayed on the subscription page, prices including VAT. Seats are assigned by the account owner to individual email addresses and can be re-assigned at any time. Business memberships can be paid by card or, on request at checkout, by bank transfer: in that case access starts immediately and a fiscal invoice is issued, payable within the term stated on the invoice. If a bank transfer invoice remains unpaid, we reserve the right to suspend the membership.

7.5. Payments and invoicing.Card payments are processed by Stripe, Inc. on Stripe’s secure payment pages; we do not store card numbers. Subscriptions renew automatically at the end of each billing period until cancelled. For each charge a fiscal invoice is issued in RON (with the EUR amount as reference) and made available in your account. VAT is applied according to the applicable law: for customers in Romania, Romanian VAT is included in the displayed price; for customers in other EU countries, VAT is applied under the applicable EU rules (including, for VAT-registered businesses, the reverse-charge mechanism); for customers outside the EU, supplies are outside the scope of EU VAT.

7.6. Cancellation. You can cancel your subscription at any time from your account page (Manage subscription). Cancellation takes effect at the end of the current billing period; you keep access until then. Cancelling during the free trial means you will not be charged.

7.7. Consumer withdrawal rights. If you are a consumer, you benefit from the statutory rights of withdrawal provided by the applicable consumer-protection legislation (including Government Emergency Ordinance no. 34/2014). 7.8. Price changes. We may change subscription prices; any change applies from the next billing period at the earliest and will be communicated to you in advance.
